Ataraxy Family Mediation Training Terms and Conditions
Participation
Participants must attend all the face-to-face (in-person or online) training days and complete distance learning tasks before, during and after the face-to-face training days. Participants are expected to take part in all activities and be comfortable with a level of self-disclosure appropriate to a professional training programme. There is an emphasis on group work, including discussions, presentations and role-play throughout the training, including the assessment process.
Qualification – Foundation Course
The Foundation course is approved by the Family Mediation Council. Successful completion of the course requires participants to demonstrate knowledge and competence in the areas set out in the Family Mediation Councils’ Manual of Professional Standards and Self-Regulatory Framework. The Manual is available on the Family Mediation Council’s website. In the Foundation course, Competence is assessed throughout the course through the participants’ written assignments, course presentations and role plays.
No guarantee is given that every participant attending will achieve the required level of knowledge and competence to fulfil the course requirements. Where a participant’s assignments fail to demonstrate the required level of knowledge or competence, they will be given an opportunity to improve the standard of their work but must submit their final assignments within three months after the end of the course delivery sessions. In the event of serious illness, close family bereavement or other compassionate reasons, please make a written submission to Ataraxy at ataraxy.training@gmail.com before the expiry of the initial three month period, detailing the reasons for the extension required. Please note extensions cannot be granted retrospectively after this period of time.
Participants who pass all the assessments will be issued with a Certificate of Completion.
Qualification – Refresher Course and CIM Awareness and Understanding Course
Ataraxy Family Mediation Training is an FMC approved foundation course training provider, and as such approved to deliver these courses. There is no formal assessment in these courses but participants are expected to demonstrate knowledge and competence as per the FMC requirements. Participants who attend and complete the course will be issued with a Certificate of Completion.
Reasonable adjustment
Ataraxy will do everything possible to make reasonable adjustments to the courses in order to meet any participant’s needs. Participants should describe any particular training needs they may have on the registration form and wait for confirmation that these needs can be met. The assessment process for some of the courses requires that participants take part in role plays and group discussions and provide written work which will form part of the course assessment.
Health and safety at in-person training course
You must comply with all health and safety rules and regulations and any other reasonable security requirements that apply at the premises at which the training courses are provided when the provision is in-person rather than online.
Online delivery courses and technology
Ataraxy Family Mediation Training delivers online courses via videoconference (Zoom). Participants are responsible for any payments that their internet service provider might charge them with while joining the sessions or downloading any material. Participants are responsible for ensuring that their internet connection is reliable and will not be interrupted and is of a quality that makes their continuous participation in the course possible.
Ataraxy Family Mediation Training is not responsible for any issues the participants might experience with their computer, such as software issues, server downtime, increased internet traffic, distorted sound or image, low bandwidth or other related issues. If the quality of the connection negatively affects the regular proceeding of the course, Ataraxy Family Mediation Training reserves the right to ask the participant to leave the session until those problems are solved (for example, by using headphones, restarting their computers, changing devices, etc.)
The final assessment in Module 3 is assessed by the external assessor as a real life mediation. If unforeseen circumstances happen on the day, the trainers and assessor will take account of this. However, any issues derived from the participant's hardware or internet connection as in the previous paragraph, which negatively affects the assessment necessitating a re-assessment, will result in the participant being responsible for any costs incurred for the re-assessment, for example role-players fees, assessor time and other disbursements.
The courses include screen sharing by the trainers of handouts, exercises, videos and general course material, and it is therefore not acceptable to participate in a course using a mobile phone.
For some courses, participants will receive a link to access all the course information and material stored in Google Drive. In participating in the course, you agree not to share this link with any other person. If you finish the course and pass it, you will be given access to the digital material for 90 days after the end of the course. In the event that the participant withdraws from the course, access to the Google Drive will be terminated with immediate effect.
Participants consent to Ataraxy Family Mediation Training recording their video assessments for the assessor to review and evaluate.
Behaviour and fair practices
Ataraxy Family Mediation Training reserves the right to remove any participant from a training course whose behaviour is deemed inappropriate by the trainers. In these circumstances, Ataraxy Family Mediation Training will neither refund any fees nor reimburse any other costs. Any abusive behaviour and unfair or dishonest practices will not be tolerated under any circumstances.
For all the formally assessed courses, all assignments presented for assessment must be the sole and individual work of the participant presenting it. Any plagiarism, collusion, or the involvement of another in the preparation of an assignment will be deemed as inappropriate conduct and may lead to disciplinary sanctions.
Where an assessor suspects one or more of the above, the assessor will raise the matter in writing with the participant who will have 14 days in which to reply. The assessor may (i) accept the participant’s written explanation, (ii) ask the participant to resubmit their work or (iii) refer the matter to the course moderator. In such circumstances, the participant will be given the opportunity to make representations to the course moderator either in writing, by video conference or in person. Those representations will be considered by the course moderator and at least one trainer/ assessor. Their decision may include removal of the participant from the course or the decision that the participant has failed the course. In either event the decision will be final. Where a participant is removed from the course or deemed to have failed it, Ataraxy will not refund any part of the course fee or reimburse any expenses that may have been incurred by the participant.
Fees and payment terms
Fees cover the costs of face-to-face (in-person or online) delivery of the course, any training materials and assessments. In the in-person courses, lunch is not included in the fee but tea and coffee will be provided.
Participants are responsible for any travel and accommodation costs incurred. Information about travel to the venue can be provided without prejudice.
Foundation course: a deposit of £500 is required when booking a place in the course. Full payment of fees needs to be made by at least 4 weeks before the course is due to start. If full payment is not received by then, the place on the course will be withdrawn although it might be possible to join a later course.
Refresher course: a deposit of £300 is required when booking a place in the course. Full payment of fees needs to be made by at least 4 weeks before the course is due to start. If full payment is not received by then, the place on the course will be withdrawn although it might be possible to join a later course.
Mediation for Family Workers course: a deposit of £500 is required when booking a place in the course. Full payment of fees needs to be made by at least 4 weeks before the course is due to start. If full payment is not received by then, the place on the course will be withdrawn although it might be possible to join a later course.
Any agreement regarding payment in instalments is at the discretion of Ataraxy Family Mediation Training after detailed discussion with the prospective participant. In cases of payment by instalments, the agreement is to pay the full fee. If the participant withdraws from the course at any stage, the full fee remains outstanding.
The participant in the course is contracting personally with Ataraxy for the delivery of the course, as per the Application Form. Therefore, the participant will be responsible for payment of the course fees. If the participant makes any personal arrangements for payments to be fulfilled by a third party, these are private arrangements between that third party and the participant in the course.
In the event of bespoke courses for organisations, the contract between Ataraxy and that external organisation will cover the terms and conditions and payment of fees.
Other courses: full payment of fees is required at the time of booking in order to reserve a place in the course.
Cancellation or date changes
Ataraxy Family Mediation Training reserves the right to cancel or re-schedule the training course. In the event that participants cannot be accommodated on an alternative course, a full refund will be given. Ataraxy cannot be held responsible for any extra costs incurred as a result of a cancelled or re-scheduled course.
If you cancel your booking four weeks or more prior to the start date, Ataraxy will refund the full course fees less an administration fee of £200. If you cancel your booking between two and four weeks prior to the start date, a 50% refund will be given. Cancelling two weeks or less prior to the start of the course, failure to attend or leaving the course part way through will result in no refund being given.
There will be no charge if you change your booking to a later course four weeks or more prior to the start date. If you change your booking to a later course between two and four weeks prior to the start date, there will be a charge of £200.
If you change your booking two weeks or less prior to the start of the course, there will be a charge of £500. If you cancel the rebooked course, refunds are not possible.
Participant substitutions can be made up to three days prior to the start of the course with no charge. Substitutions have to be for the same course cohort.
Copyright
The copyright and all other intellectual property rights in all course materials remain the sole and exclusive property of Ataraxy Family Mediation Training. In participating in any of the courses, you agree not to transfer (electronically or otherwise), reproduce, copy or permit the photocopying of course materials, written, video or audio, nor modify, redistribute, disclose or permit the disclosure or sell or hire the same to anyone outside of the course, nor use the same for running your own courses unless agreed in advance and in writing by Ataraxy.
For some of the online courses, participants will receive a link to access all the course information and material stored in Google Drive. In participating in the course, you agree not to share this link with any other person. No material can be copied, reproduced, uploaded, posted, displayed or linked to in any way, in whole or in part, without Ataraxy Family Mediation Training prior permission. Any such use is strictly prohibited and will constitute an infringement of our intellectual property rights.
Acting in good faith
All information and materials provided by Ataraxy Family Mediation Training are given in good faith, and Ataraxy Family Mediation Training will not be held responsible for any act or omission from a participant or any other individual or organisation as a result of the use of the information provided or views expressed during the training course, including course materials. Participants should take professional advice when dealing with specific situations.
